General Terms and Conditions

1. Scope of application

The General Terms and Conditions (in the following GTC) are an integral part of the contract between Schäfer-Shop AG (in the following Schäfer Shop) and the purchaser and apply to all articles which are carried by Schäfer Shop in its sales outlets and online trading. Any different agreements between the parties must be in writing in order to be valid. The version of the GTC at the time of the conclusion of the contract (available at https://www.schaefer-shop.ch/en/terms-and-conditions) shall apply.

2. Prices

Unless otherwise agreed, the prices are net excluding VAT in Swiss francs. If the order value is less than CHF 100.00, a handling fee of CHF 8.90 will be charged.

3. Payment options

The goods can be purchased by prepayment, PayPal, TWINT, credit card (VISA, MasterCard) or invoice. Schäfer Shop may exclude individual means of payment in general or for individual customers without further explanation. Schäfer Shop reserves the right to carry out creditworthiness checks on customers by an appropriate credit rating institute. The customer agrees to the forwarding of the necessary data. In the case of payment by PayPal, the PayPal terms of use of PayPal (Europe) S.à.r.l. & CIE.S.C.A. apply. In the case of payment by TWINT, the TWINT terms of use of TWINT AG apply. In the case of payment by invoice, payment must be made within 30 days of the invoice date. From the due date, interest on arrears of 5% is owed. From the 2nd reminder onwards, additional reminder costs of CHF 20.00 per reminder will be charged.

3.1 Digital communication channels

By accepting the General Terms and Conditions, you agree that contract-related communication - such as the delivery of the invoice - may take place in digital form, e.g. by e-mail.

4. Delivery and assembly

The delivery dates apply according to the order confirmation. When purchasing by prepayment, PayPal, TWINT and credit card, delivery will only be made after receipt of payment. Delivery is free of charge in Switzerland and the Principality of Liechtenstein. Excluded are deliveries over 30 kg and separately marked items. These are delivered free to the kerbside. Deliveries to car and duty-free areas are made free valley station. Installations on the wall, ceiling or floor are excluded from the installation service. Further transport and assembly costs are not included in the prices unless the parties agree otherwise.

5. Retention of title

Schäfer Shop retains ownership of the purchased item until the invoice amount has been paid in full and is entitled to arrange for a corresponding entry to be made in the register for retention of title at the purchaser's expense. The buyer is obliged to inform Schäfer Shop immediately of any change of residence.

6. Retention with regard to technical data as well as colour and structure differences

All information on weights, dimensions, capacity, load-bearing capacity, etc. is non-binding. We reserve the right to make changes in shape, colour, material and changes in the interest of technical progress.

7. Right to withdraw

For unused, as-new standard stock items, the buyer has a right of withdrawal of 10 days. The period begins with receipt of the goods. The return shipment must be made in undamaged condition and in the original packaging. The transport costs will be charged to the buyer. In the case of collection by Schäfer Shop, the following costs will be charged: Postal collection CHF 20.00/parcel; collection by forwarding agent CHF 100.00/trip. There is no right of withdrawal for custom-made products, opened software, items already assembled at the buyer's premises, goods ordered at the customer's request and for items that are not part of the catalogue range.

8. Checking of the goods / notice of defects

The buyer is obliged to check the goods for completeness and intactness immediately after receipt. Notification of defects must be made immediately, at the latest within 8 days. Hidden defects must be reported to Schäfer Shop immediately, at the latest within 8 days of their discovery.

9. Warranty / Guarantee

The buyer's warranty claims expire one year after receipt of the goods. If there is a material defect, Schäfer Shop has the right to choose between rectification or replacement. In this case, the purchaser's claim for cancellation or reduction as well as compensation is excluded. The claim for cancellation and reduction shall be revived if the rectification is unsuccessful. The warranty is expressly excluded for consumer goods. If other warranty conditions are stated in the online shop (e.g. on the basis of a manufacturer's warranty), these warranty conditions apply with the deadlines noted there.

10. Liability for delivery damages

In the case of generic goods, benefit and risk shall pass as soon as the goods have been marked out for dispatch. In the case of speciality goods, the benefit and risk shall pass to the buyer upon conclusion of the contract. The buyer is obliged to check the goods for completeness and defects upon delivery by the service partner. The service partner must be notified immediately on site of any delivery damage and claims must be made against the service partner.

11. Privacy Policy

12. Salvatorian clause

Should individual provisions of these GTC, including this one, be totally or partially invalid or unenforceable or become invalid or unenforceable after the conclusion of the contract, the validity of the remaining provisions of this contract shall remain unaffected. The invalid or unenforceable provision shall automatically be replaced by a valid and enforceable provision whose effect comes closest to the economic objective of the invalid or unenforceable provision. The same shall apply in the event of unforeseen gaps in the GTC.

13. Applicable Law / Jurisdiction

Swiss law is exclusively applicable to the exclusion of the conflict of laws rules and the Vienna Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Balsthal.
